The Failure of the 28-Article Ceasefire Plan for Ukraine: Why Peace Negotiations Continue to Stumble

Europe breathed a deep collective sigh of relief on Monday, as the tension caused by the introduction of a new 28-article proposal for resolving the conflict appeared – temporarily – to have been defused. A senior US official spoke of "notable headway" after Ukraine-US talks in Geneva. On Monday night, the Kremlin made its retaliation: another massive barrage of aerial bombardment on Kyiv.

The Pattern of Diplomacy and Destruction

The succession of opposing developments captured the bleak nature of the current period. By day, political struggles are fought: positive announcements are delivered from different nations. Considerable effort is expended on containing specific proposals. By night, the Kremlin brutally reminds the world that, for them, military action persists as the main instrument for achieving "peace".

After-Dark Attacks

As Russia's attack unfolded into the early hours of Tuesday, the present situation of Ukraine's vulnerability was laid bare. Ukraine is capable of detecting missile launches from enemy soil, a capability provided through current data. From witness perspectives, military aircraft that had been deployed to counter approaching aerial threats roared overhead – advanced fighter aircraft delivered to Ukraine by NATO members.

Shortly after, Kyiv's anti-aircraft weapons thundered: multiple launches fired to intercept a Russian ballistic missile. This was a advanced protection mechanism at work, most likely delivered by allied countries. Every deployment shakes the surroundings, rattling buildings. The instant of fear quickly transforms into resigned acknowledgment: perhaps the incoming missile won't hit its mark this time, protecting urban areas from devastation and further power outages.

Continuous Dangers

Soon after, a large-caliber weapon opened up on a drone somewhere nearby, part of a mobile-fire group – probably allied-provided weaponry. Regrettably, the bullets missed the hostile drone – it maintained course toward its destination.

With pauses, this persisted until dawn. Kyiv greeted the early updates: seven people killed, damage and heating outages in numerous residences as a result of the nocturnal offensive. As typically, everyone still continued their routines – living the war. But those entire period demonstrated Ukraine's vital need on international aid – a dependence that regional partners are demonstrably unable to fill in the short term.

Unsuccessful Negotiations

The 28-point plan from Washington generated strong feelings, discussion and deep concern – and temporarily diverted attention from Ukraine's most significant graft case in years. Yet, we have experienced comparable situations, after earlier high-level meetings and international summits.

Every new approach from American administration adheres to the same pattern: a diplomatic cavalry charge against Ukraine, which Kyiv, with partner nations, succeeds in resisting. They contain the crisis but never actually win the battle. This trend will, undoubtedly, endure.

Strategic Calculations

It is tempting to accuse certain parties of repeatedly advocating Moscow's conditions. But that does not seem to be the whole story. American leadership operates on a principle understood by international relations experts: you cannot win at the negotiating table what you have been unable to protect through force. The White House presumes that it is unfeasible to pressure the Kremlin to surrender the areas that it already controls in Ukraine's south or east.

The problem is that while accepting these circumstances, Washington does little to discourage Russia, through words or deeds, from assuming that the status quo will not shift further in its benefit in the months ahead.

Divergent Views

Therefore, Russian leadership is confident that duration works to their advantage – that Ukraine and its partners are coming close to fatigue. Their motivation to agree to terms that does not give them the greatest potential benefit is almost completely absent. There may be numerous efforts to achieve ceasefire, but they will continue as long as Russia's government remains highly assured in the result.

On the contrary, Ukrainian leadership believes that Ukraine can still persist, slowly losing civilians and areas but preventing a entire defensive failure until conditions improve in its benefit.

Current Realities

Realistically, there are no genuine requirements for a truce. Now, individual motivations are entering the equation: personal goals to mediate resolution and secure international recognition, and the government's twin challenges – on one hand, not to distance important partners, and on the other, to unite the population around the flag against any proposal Kyiv finds unworkable, so that their attention does not move to homefront challenges. And although their task will now be much harder after recent developments, it remains highly unlikely that this will alter their fundamental strategy.

These opposing factors are guiding negotiations.

Summary and Prospects

It took a only one week to kill the proposed articles of the latest plan. Aggressive and erratic handling of the matter by Washington, resistance by Ukraine and the other European countries, along with soothing efforts of negotiators, and finally, latest revelations, all achieved their purpose.

While new initiatives based on previous concepts are forthcoming, Kyiv, London and other European capitals should reach an essential realization: Ukraine and Europe will only be able to counter negotiation assaults from Washington that are founded on Moscow's terms and show certain reluctance to modify developments, if they remain united and strengthen their defence capabilities at a significantly accelerated rate. If they do, neither political nor armed coercion will be able to break them. In the meantime, Ukraine's capacity to counter nocturnal attacks will, for the predictable period, primarily depend on sustained allied backing.
